1.The agreement
usnapit is operated by SimplyIQ Inc ("we", "us"), a company registered in Florida, United States. usnapit estimates the calorie, macro and nutrient content of food and drink - from a photo, from a description you type, from a barcode, or from a restaurant menu - and tracks that against a goal you set. These terms, together with our privacy policy, are a binding agreement between you and us. By creating an account or using usnapit you accept them. If you do not accept them, do not use the app.
You must be at least 16 to use usnapit, and if you are under the age of majority where you live you confirm a parent or guardian has agreed to these terms on your behalf.
2.Estimates are estimates
Nutrition figures are produced by an AI model looking at a photograph or reading a sentence. They will not be exact. Portion sizes, hidden oils, sauces, cooking methods and brand differences all move the real number. Treat every figure as a useful guide, not a measurement, and correct anything that looks wrong - the app lets you edit every item. You are responsible for checking any figure you rely on.
The same applies to alcohol. usnapit estimates how much of a drink's calories came from alcohol so it can show you the split, but pour sizes and recipes vary enormously and the figure is a guide only. It is not a measure of how much you have drunk, and it is not a health assessment.
Barcode figures come from Open Food Facts, an open database maintained by volunteers. We do not check them and cannot guarantee them. Menu prices and their currency conversions are read from a photograph and an exchange rate at that moment; the printed price is the one you will be charged.
3.Not medical advice
usnapit is not a medical device and does not give medical, nutritional or dietary advice. Nothing in the app - a target, a budget, a projection, a fact, a summary, a badge - is a diagnosis, a treatment or a recommendation for your particular body, and nothing in it establishes a practitioner-patient relationship. It does not know your medical history. Talk to a doctor or a registered dietitian before making significant changes to how you eat, particularly if you are pregnant, managing a health condition, taking medication, under 18, or have any history of disordered eating. If you have, or suspect you have, an eating disorder, do not use a calorie tracker without professional supervision.
4.AI-generated content
"What your log says", the meal estimates and the menu reader are produced by an artificial intelligence model. Such output can be wrong, incomplete or out of date, and can occasionally be wrong in ways that are not obvious. We do not review it before you see it. It is offered for information only, you use it at your own discretion, and we accept no responsibility for any decision you make on the strength of it.
5.Connecting Apple Health or Health Connect
Connecting your phone's health app is optional and off unless you turn it on. If you do, usnapit reads your weight and the energy you burn, and uses the last few days of energy burned, averaged, to set your daily calorie target in place of the activity level on your profile. It needs at least three days before it will do that, it ignores the current day because it is unfinished, and if the readings stop arriving it goes back to your profile rather than holding the target at whatever it last saw. It writes back only a weight you typed into usnapit yourself, dated to the day that weigh-in is for, and it ignores its own entries when reading, so a weight you typed never returns as one your devices measured.
Those readings come from your phone, your watch or whatever else writes to it, and usnapit cannot check whether they are right. A device worn loosely, left charging, or simply inaccurate will produce a target built on a bad number. Days with no readings at all are skipped rather than counted as zero, and implausible totals are discarded, but those are safeguards, not a guarantee of accuracy. You are responsible for the data your devices write.
You can disconnect at any time, in usnapit or in your phone's own health settings. The app falls back to the activity level on your profile and to figures you enter by hand, and nothing stops working.
6.Your account and your conduct
Keep your password to yourself; you are responsible for everything that happens under your account, whether or not you authorized it. Tell us at once if you think it has been compromised. You must give us accurate information and keep it accurate.
You agree not to: use usnapit to break any law; attack, probe, overload, scrape or interfere with the service or with other users; reverse engineer, decompile or copy the app or its models beyond what the law expressly allows; access it by any means other than the app we publish; resell it or use it to build a competing product; circumvent the free allowance, the subscription or any limit; or submit content you have no right to submit or that is unlawful, harmful or offensive.
7.Subscriptions and the free allowance
usnapit Pro is $6.99 per month, or $70.99 per year - a saving of about 15% - with a 7-day free trial for new subscribers, where the store offers one. Prices may vary by country and may change; a change applies from your next renewal and the store notifies you. Billing is handled entirely by Apple or Google, not by us, under their terms. Subscriptions renew automatically until canceled at least 24 hours before the end of the current period, and you cancel through your App Store or Google Play account settings. Refunds are Apple's and Google's to give under their own policies; we do not issue them. Cancelling stops the next charge and does not refund the current period.
Logging is free. Typing a meal in, editing it, scanning a barcode, weighing in and keeping your whole history cost nothing, with no account limit and no expiry. What the subscription buys is the AI: photo estimates, described meals, the menu reader and "What your log says", along with the health connection and the measured target. Without one you get a small number of free AI actions to try them, and when those run out the rest of the app carries on working - nothing you have logged is ever locked away, and your history stays readable and exportable whether or not you ever pay.
We may change what is free and what is paid, the size of the free allowance, and the features in Pro, as the service develops. Where a change removes something from a plan you have paid for, it takes effect from your next renewal.
8.Targets, budgets and projections
Your daily calorie target starts as a formula - a population average worked out from your height, weight, age, sex and activity. After a few weeks of logging, usnapit can do better: it solves what you actually burn from your own intake against your own weight trend, and shows that as a suggestion, with the evidence it used attached. It never silently changes your target, and we would rather show nothing than a number built on too little data - which is why several parts of the app say "not enough yet" instead of guessing.
Projected dates, weekly summaries, milestones, a goal marked as reached and the weight trend line are arithmetic on what you have logged. They assume the recent past continues, which bodies do not reliably do. They are not predictions, and no part of the app should be read as a promise about a result.
usnapit will not set a target below a floor tied to what you burn, whatever rate of loss you ask for. If you want to eat less than that, this is not the app to help you do it.
9.Reminders and streaks
Reminders are optional and are scheduled by the app on your own device. There is no push server, no notification token, and nothing about what you logged is sent anywhere to decide when to notify you. You can turn any of them off in usnapit, or all of them in your phone's settings. We do not guarantee that a reminder will arrive; your phone decides that.
Streaks, freezes and milestones are there to make logging a habit worth keeping. They are not a measure of your health and they carry no consequence: losing a streak costs you nothing, and no feature of the app is gated behind one.
10.Coins, tiers, badges and themes
Coins, tiers, badges, themes and any other reward inside usnapit are features of the app, not property. They have no cash value, cannot be bought, sold, transferred or redeemed for anything outside the app, and are not a currency. They are derived from your log by rules we set, and we may change those rules, adjust balances that were awarded in error or through abuse, add or remove rewards, or discontinue the system altogether, at any time and without compensation. A theme you have unlocked stays unlocked for as long as the app offers it.
11.Location, for menu prices only
If you photograph a restaurant menu, usnapit asks once for your approximate location so it can tell which currency the prices are in and convert them to yours. It is country-level only, the coordinates stay on your phone, and declining costs you nothing - the menu still reads, and prices are shown exactly as printed.
12.Your devices, and your log across them
If you sign in, your log syncs to your account and to your other devices. usnapit merges what each device has rather than letting whichever synced last overwrite the rest. Deleting an entry deletes it everywhere, and deleted entries are recoverable for 30 days before they go for good. Sync depends on your connection and on our providers, and we do not guarantee it is instantaneous or that nothing is ever lost; export your data if you need a copy you control.
13.Your content, and our license to it
Your photos and your log remain yours. You give us a worldwide, royalty-free license to store, copy, process and transmit them, and to pass them to the providers named in our privacy policy, solely to operate, maintain and improve the service for you. We do not use them to train AI models and we do not sell them. You are responsible for what you submit and confirm you have the right to submit it. The share card is yours to send; once sent, where it goes is your responsibility.
14.Our property
usnapit - the app, this website, the name, the mark, the design, the copy, the prompts, the arithmetic and everything else that is not your content - belongs to SimplyIQ Inc or its licensors and is protected by copyright, trade mark and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, for your own non-commercial use, subject to these terms. No other right is granted. Feedback you send us may be used without obligation to you.
15.Availability, and no warranty
The service is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that usnapit will be uninterrupted, timely, secure or error-free, that any figure it shows is correct, that defects will be corrected, or that it will meet your requirements or produce any particular result - including any change in your weight or health. We may change, suspend or withdraw any part of the service at any time.
16.Limitation of liability
To the fullest extent the law allows, SimplyIQ Inc, its officers, directors, employees, contractors and providers are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, goodwill or health, arising out of or in connection with usnapit or these terms, however caused and on any theory of liability, even if we were told such damages were possible. Our total liability to you for all claims together is limited to the greater of the amount you paid us for usnapit in the twelve months before the claim arose and fifty US dollars. Some jurisdictions do not allow some of these limits; in those, they apply to the extent permitted, and nothing here limits liability that cannot legally be limited.
17.Indemnity
You agree to defend, indemnify and hold harmless SimplyIQ Inc and its officers, directors, employees, contractors and providers from any claim, loss, liability, damage and expense, including reasonable legal fees, arising from your use of usnapit, your content, your breach of these terms, or your violation of any law or of anyone's rights.
18.Governing law and disputes
These terms are governed by the laws of the State of Florida, and by the federal law of the United States where it applies, without regard to conflict-of-law rules. Any dispute arising out of them or out of usnapit is subject to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction. You agree to bring any claim only in your individual capacity, and not as a plaintiff or class member in any class, collective or representative action. Any claim must be brought within one year of the event that gave rise to it, or it is barred.
If you are a consumer living outside the United States, this does not take away rights you have under the mandatory consumer-protection laws of the country you live in, or the right to bring a claim in your local courts where that law gives it to you.
19.Changes to these terms
We may update these terms as usnapit changes. When a change is significant, the app asks you to agree again the next time you open it, and shows you what changed rather than simply repeating the whole document. Lesser changes take effect when posted here, with the date at the top updated. Continuing to use usnapit after a change is acceptance of it. If you would rather not accept a new version, you can stop using usnapit and delete your account.
20.Ending it
You can stop using usnapit and delete your account at any time. We may suspend or terminate your account, or your access to any part of the service, at any time and without notice if we reasonably believe you have broken these terms, the law, or a store's rules, or where operating the service for you is no longer practical. Termination does not refund any period already paid to a store. The sections of these terms that by their nature should survive - including those on estimates, medical advice, your content, our property, warranty, liability, indemnity and disputes - survive it.
21.General
These terms and the privacy policy are the entire agreement between you and us about usnapit and replace anything earlier. If any part is found unenforceable, the rest stands. Our not enforcing a term is not a waiver of it. You may not assign these terms; we may assign them to a successor. We are not responsible for delay or failure caused by events beyond our reasonable control. Apple and Google are not parties to this agreement and have no obligation under it, though where their store rules require, they may enforce it as a third-party beneficiary.
